Terms of Service & End User License Agreement
Welcome to Item Locator ("App", "we", "us", or "our"). These Terms of Service and End User License Agreement ("Terms", "Agreement") govern your access to and use of the Item Locator mobile application, website, and related services (collectively, the "Service").
By downloading, creating an account, accessing, or using Item Locator, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
1. Eligibility and User Accounts
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use Item Locator. By creating an account, you represent and warrant that all registration information you provide is true, accurate, and current. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
2. Permitted Use & Location Services
Item Locator allows users to discover, locate, list, buy, sell, and request products and items in their proximity, and interact with community members via messaging and livestreaming. You agree to use the Service solely for lawful purposes and in accordance with these Terms.
Certain features rely on precise geolocation data. You control location permissions directly through your device settings. Accurate proximity search requires enabled location permissions.
3. User Generated Content & Zero-Tolerance Policy
Item Locator maintains a strict zero-tolerance policy against objectionable content, harassment, abuse, illegal listings, fraudulent activities, and inappropriate behavior.
Users are strictly prohibited from posting, uploading, sharing, or transmitting any content that:
- Is defamatory, obscene, pornographic, sexually explicit, vulgar, or promotes illegal acts.
- Promotes violence, discrimination, hatred, or harassment against individuals or protected groups.
- Infringes any patent, trademark, trade secret, copyright, or other proprietary rights.
- Involves counterfeit items, stolen goods, controlled substances, firearms, or hazardous materials.
- Attempts to impersonate another individual or business entity.
Safety Measures & Enforcement:
- In-App Reporting: Users can instantly report any listing, message, comment, or user profile directly within the app.
- Blocking: Users can block abusive users at any time to immediately prevent all contact and hide their content.
- Moderation: Reported content is reviewed promptly. We reserve the right to immediately remove any objectionable content and suspend or permanently terminate offending accounts without notice.
4. Subscriptions, In-App Purchases, and Billing
Item Locator may offer premium features, merchant store memberships, or expanded listing privileges through auto-renewable subscription plans ("Subscriptions").
- Payment will be charged to your Apple ID / Google Play account upon confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the specified plan rate.
- You can manage or cancel your subscriptions anytime by going to your App Store or Google Play Store Account Settings after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when purchasing a subscription.
5. Marketplace Transactions and Disclaimer
Item Locator provides a discovery and connection platform. Unless explicitly stated otherwise, Item Locator is not a party to transactions conducted directly between buyers and sellers. Users are responsible for verifying the authenticity, quality, safety, and legality of any items transacted. Exercise standard precautions when meeting in person or transacting.
6. Intellectual Property
The Service, its original content, features, logos, and functionality are the exclusive property of Item Locator and its licensors. You are granted a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly for personal or authorized business use in accordance with this Agreement.
7. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including violation of these Terms or engagement in prohibited conduct. You may also delete your account at any time through the in-app settings.
8. Limitation of Liability and "As-Is" Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. In no event shall Item Locator, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be communicated through the app or by updating the "Last Updated" date at the top of this page. Continued use of the Service constitutes acceptance of the modified Terms.
